This agreement is between Notilus Yat Tasarım Mühendislik Bilgisayar Sanayi Ticaret Limited Şirketi (Notilus Software, "Notilus") and the person or organisation that installs or uses Notilus software ("you"). By installing or using the software you accept it. A signed agreement or accepted quote takes precedence where it differs.
Notilus grants you a non-exclusive, non-transferable licence to use the software for your own internal purposes, on the number of seats and for the licence type (perpetual, annual or monthly) stated in your order. A free trial, where offered, is for evaluation and ends automatically.
You may not copy the software (except one back-up), reverse-engineer it except where the law allows, bypass its licence protection, rent, sublicense or transfer it, or use more seats than you paid for.
The software is licensed, not sold; Notilus keeps all rights in it, and your own models and data remain yours. Rhinoceros® and, for Notilus CFD, OpenFOAM® must be licensed separately from their owners. Rhinoceros® is a registered trademark of Robert McNeel & Associates. OpenFOAM® is a registered trademark of OpenCFD Limited; Notilus CFD is not affiliated with, endorsed by or sponsored by OpenCFD Limited.
The software is a design aid. You are responsible for checking its results, for design decisions based on them and for any approvals required by classification societies or authorities.
Notilus will make reasonable efforts to keep the software working as described but does not guarantee that it is free of errors. To the extent permitted by law, Notilus is not liable for indirect loss, and its liability is limited to the fees paid for the licence in the last twelve months. This does not limit liability for intent, gross negligence or injury, or the mandatory rights of consumers.
The licence ends when its period ends. Notilus may end it if you seriously breach this agreement. You must then stop using and delete the software.
Turkish law applies. The courts and enforcement offices of Antalya have jurisdiction over disputes with businesses; consumers keep their mandatory rights.
